About Aggravated Battery
Facing aggravated battery charges?

In the state of Florida, aggravated battery is covered under Section 784.045 of the Florida Statutes. Under §784.045 Aggravated Battery – a person is guilty of committing aggravated battery when they do the following:
- Intentionally or knowingly cause great bodily harm, or permanent disability or permanent disfigurement; or
- When they use a deadly weapon (this is subject to interpretation, a deadly weapon can be a firearm, a knife, a hammer, a crowbar, or anything that can cause great bodily harm or death).
- When the person commits aggravated battery against a pregnant woman and at the time of the offense, the assailant knew the victim was pregnant.
Aggravated battery is a felony of the second degree, which is punishable by up to 15 years in a state prison and a maximum fine of $10,000. Additionally, the defendant may be ordered by the court to pay restitution to the victim.
